Terms and condition of use

1. General information

The general conditions of sale contained herein apply to all products sold exclusively through this E-Commerce website. They define the rights and obligations of the parties.

Petness.ch reserves the right to modify at any given moment the content and form of these general conditions of sale.

2. Personal data

Petness.ch shall respect the privacy of the personal data communicated by the customers on the E-Commerce website and shall manage the data in accordance with applicable legal obligations.

Customers’ data may be used for internal services for the following purposes:

For the management of orders, deliveries and billing
To inform the customers of sales and events by way of e-mails of invitation
To improve and customize the communication towards the customer, by way of sending newsletters, special offers and other e-mails.

3. Sale process

3.1.      Orders

Once the desired product has been chosen, it is placed in the “shopping cart” by clicking the button “Add to cart”. The customer may then continue his selection of products, modify his shopping cart or proceed with the payment of the order.

The confirmation of the order by the customer serves as acceptation of the general conditions of sale.

Once the order confirmed and paid, the customer receives by e-mail a confirmation of his order.

Petness.ch reserves the right to refuse orders without stating its reasons.

3.2.      Price

The prices mentioned for each product on the E-Commerce website shall be understood as including all taxes, but excluding delivery fees. The delivery expenses of the order shall be indicated prior to the final confirmation of the order.

Petness.ch reserves the right to modify, without prior warning and at any moment, the prices and other fees published on the E-Commerce website. However, the products will be billed to the customer on the basis of the tariffs in force at the moment of the confirmation of the order.

The prices applicable are in the currency of CHF.

3.3.      Description of the products

Petness.ch shall ensure that the products and services sold through the E-Commerce website are depicted by photographs with the highest possible accuracy. However, due to the mode of presentation of these products on the Internet network, it is possible that the perception of the customer of the photographic depiction of the products does not exactly correspond to the products themselves.

Our web pages were created with the greatest care. Nevertheless, we do not accept liability for the accuracy and integrity of information provided.

3.4.      Delivery

Delivery fees are calculated at the end of the order process. These delivery fees are supported by the customer and are added to the subtotal order price. 

Petness.ch guarantees the expedition of the products sold through the E-Commerce to Switzerland and to Liechtenstein and to no other country. The products will be sent to the delivery address indicated by the customer during the order process. The address must be a valid address in Switzerland or in Liechtenstein and must be accessible by the post or any other delivery carrier.

3.5.      Returns and refund

Any return of merchandise must be the subject of a formal written agreement between Petness.ch and the purchaser, by email, within 3 working days of receipt of the merchandise.
Any merchandise returned without this agreement would be refused by Petness.ch.
No return will be accepted after a period of 5 days following the return agreement given by Petness.ch.

Expenses and risks for return are always chargeable to the buyer. (with the exception of a bad article sent by error by Petness.ch)

You received the wrong product

You ordered the wrong size or the size is not suitable for your pet (only for harnesses and leashes)

No right of return

Unfortunately, we cannot offer a take-back for the following cases:

The product has been used

The entire product cannot be returned in its original packaging

Open articles of the following categories: items not included for hygiene reasons: litter and accessories, cat tree and cat scratching post, food and feeding accessories, bed and cushion, basket and transport bag, shampoo and brush, harness, etc. (with the exception of harnesses taken out of their packaging for a fitting on the animal).

In case of transport damage

If you have received damaged goods during transport, please proceed as follows:

1. Take pictures of the damaged item and packaging and forward them to contact@petness.ch
2. Keep absolutely all the elements of the original packaging.
3. Address your query directly to the carrier who made the delivery: Swiss Post / Post Logistics kundendienst@post.ch o tel: 0848 888 888

We are not responsible if the package is stolen or lost. 

If the package is not acknowledged and never picked up by the customer, the return delivery fees are billed to the customer. 

For any anomalies, other than transport disputes

It will be up to the buyer to provide any justification as to the reality of the defects or anomalies observed.

The only obligation of Petness.ch would be the free replacement of the goods, a refund or the establishment of a credit note, at its option.

Right of return for a defective product

The product is like new, unused, only unpacked and can be returned in its original packaging

No right of return for a defective product

Unfortunately, we cannot offer a take-back for the following cases:

The product has been used

The complete product cannot be returned in its original packaging

Refund at the purchase price:

The product is still in its original packaging, like new, unused.

Deduction based on the condition of the goods. Individual assessment on a case-by-case basis (minimum deduction: CHF 10).

The item has been opened and used (with the exception of harnesses taken out of their packaging for a fitting on the animal).

The packaging of the item is damaged.

4. Applicable law

The present general conditions of sale, as well as any sale to which they apply, are subject to Swiss law. Any litigation or dispute arising from or in connection with these general conditions of sale or with any sale to which they apply will be settled in accordance with Swiss law, whether the claim is based in contract or in tort or upon any other legal foundation.
